MEMBERSHIP AGREEMENT - Please read carefully

1. Definitions
a) Lift Fitness, hereinafter referred to as LF with NIPC 515409502, responsible for the Club's associative and sports activities.
b) Club - physical space, at Rua Gago Coutinho, Nr 4, 8600-513 Lagos where LF develops its associative activity.
c) Associate - Natural person adhering to this contract and user of the Club.

2. Purpose
a) The purpose of this contract is to access the Club and make equipment and modalities available to the Members, for the practice of physical and sports activities.

3. Membership
a) The Member have to fill membership form, which is an essential condition to get the membership.
b) The Member must proceed with the payment of the registration fee and the first monthly fee at the time of registering.
c) The accession of minors under 18 years of age must be authorized and signed by those who exercise parental authority, guardianship or any other legal form of representation of the minor, which must be proven in the act of accession.
d) Minors between 14 and 16 years of age may attend the Club, always accompanied by those who exercise parental authority, guardianship or any other legal form of representation of the minor.
e) LF is free to review, accept or refuse membership applications for Members.
f) Membership is automatically accepted, unless otherwise stated in writing, within 3 (three) days after filling the membership form. Considering the contract signed on the date mentioned in this contract and membership form.

4. Membership Rights
a) Access to the Club and to the facilities during the agreed modalities and times, with the exception of areas that the ADLF reserves, permanently or on time, for organized and / or specific activities.
b) Number of weekly entries are defined according to the initial agreement. The unused weekly visits cannot be used in the following week. Member will lose the unused days.
c) Supervising and non-individualized assistance by LF employees.
d) The right to attend the Club may be interrupted by LF to carry out improvement or repair works, without any penalty or refund of the amount paid by the Member.

5. Duties of the Member
a) Under the terms and for the purposes of Law no. 5/2007, of 16 January, the Member must ensure that he does not have or reveal any contraindications to the practice of physical activity. Member takes full responsibility for the non-compliance of that duty.
b) Use the Club, its assets and modalities, in accordance with the internal regulations.
c) To know, observe and comply with the rules of procedure and schedules in force.
d) Proceed with urbanity and education in relation to all other Associates and employees of LF.
e) Accept the indications and recommendations given to you or requested by LF employees.
f) Proceed punctually to the payment of the registration fee, monthly and other payments due, as well as the benefits required of it by The LF in accordance with the law, the contract, the regulations and in case of goods and activities not included in the Rights of the Member.
g) Communicate to the Club Reception, as soon as possible, any changes to address, telephone, e-mail and other means of contact contained in this Agreement.

6. Use of the Club
a) The schedule of the classes, gym and other modalities, as well as the opening hours, will be established by LF. FL reserves the right to fix different schedules for the Associates according to the specific conditions of the respective adhesion.
b) The internal regulations are posted at the Club in very visible places and can be delivered to the Member at any time at his request.
c) Lockers are available for daily use. The Members must remove his belongings at the end of his daily use.

7. Benefits Payable by the Partner
a) Registration fee - membership as an Associate have to proceed the payment of a registration fee, the value of which is applied by LF on the date of acceptance of membership and which is duly identified on the membership form.
b) The Member will pay a 4 (four) week acess fee, regardless of the effective use made by the Club. The 4 (four) week fee may be freely changed by the LF. The Member may accept the change or if not accepting it, the contract will be extinguished on the last day of the month.
c) In the event of war, acts of terrorism, explosions, revolution, natural disasters, pandemics, epidemics and other events beyond the control of the LF, there will be no compensation for monthly fees paid.

8. Payment, Promotions and Penalties
a) The 4 (four) week fee must be paid on the 1st (first) use of the 4 (four) weeks to which it relates.
b) On the 1st (first) day of each month, access to the Club is subject to the payment of the monthly fee for the current month.
c) Failure to pay the 4 (four) week fee may result in the termination of the contract and the refusal of access to the Club.
d) In case the Member is under 18 years old his/her parental authority, guardianship or any other legal form of representation of the minor, who authorized and signed the membership form and this contract, is required to pay the 4 (four) week fee.
e) The bracelet is personal and non-transferable, the misuse of the bracelet will result in expulsion from the Club.

9. Duration of the Contract
a) The contract is concluded for a minimum period of 4 (four) weeks, automatically renewing for the same period.
b) Upon renewal, it may undergo changes, according to inflation or others, of LF's entire responsibility.

10. Suspension or cancellation
a) Any request for suspension of membership must be made in writing, in a specific form for this purpose, 5 (five) days in advance.

11. Civil Liability
a) LF is only responsible, either contractually or non-contractually, for the actions and omissions of its representatives, employees and collaborators, under the terms and limits of the law and when they have acted with intent or serious fault.
b) The Member is subject to report to the LF for all damages, thefts and other losses, the responsibility of which will be imputed to him, occurring in the Club and / or in the equipment made available to him.

12. Personal Data and Right to Image
a) The collected personal data are processed automatically and are intended to establish the quality of Associate, collection of contributions and future contacts, namely direct marketing actions, offer of products and service related, albeit indirectly, with the activity of LF.
b) The collected data is also intended for compliance with legal obligations and for use in contractual relations with Insurance Companies, Banks and other Institutions, with LF committing itself to keep strict confidentiality on all data, reserving access to them when necessary.
c) In case of non-compliance by the Member, the data may be transmitted to third parties for the purpose of collecting the debt.
d) The respective holder is guaranteed the right to access and rectify them, as well as the right to oppose the processing of data for marketing purposes, under the terms of Law No. 67/98, of 26 October.
e) The Member assigns the image rights to LF in all activities promoted by the Club, as well as during its normal operation in accordance with the provisions of article 79 of the Civil Code. This right to use the image, freely granted by the Member, is legitimately and free of charge authorized by the Member and agreed with the LF. The right to use the image granted by the Member to LF, begins on the date of creation and is granted without a time limit.
f) LF is now authorized to reproduce and launch the image of the Member in the media (TV, Facebook, Instagram or YouTube) without the need for any previous communication to the Member.

13. Insurance and accidents at the Club
a) In the event of an accident, at the Club's premises, during the practice of a modality assisted by an LF employee, LF insurance can be activated, and the amount of the deductible (90 €) must be paid and a form filled out at the reception, at the same time of the occurrence.
b) Activating the insurance, after leaving the Club, without having been verified by the responsible employee, makes it impossible to activate it.

14. Communications
a) All communications between the parties that result in the amendment of this contract will be made in writing and between the addresses agreed in this contract, in point 1.
b) Without prejudice to the provisions of the preceding paragraph, all communications and information to Members provided for in this contract and in the internal regulations, even if they imply changes to the referred documents, will be carried out, unless otherwise specified, through information posted at the Club. The Information will be located clearly visible location and available at the reception, with 30 days prior to its entry into force. The Associate have the option of terminating the contract, without any penalties.

15. Forum
a) This contract is governed by Portuguese law. To resolve any dispute arising from this contract, the jurisdiction of the District of Lagos is competent with express waiver of any other.
